Mr. Payette first published this book in 1994 following the coming into force of the Quebec Civil Code and he has updated it three times. The first and second editions of the book were awarded The Foundation of Legal Research’s Walter Owen Book Prize, which recognizes “excellent legal writing and to reward outstanding new contributions to Canadian legal literature.” This book has become an essential point of reference for lawyers in this field as well as for courts hearing cases on the subject.
The new edition has become essential following legislative amendments made in 2009 with respect to the creation and the maintaining of pledges, the sections added to the Quebec Civil Code relating to the obtainment of security on securities and security entitlements, as well as the evolution of interpretations in doctrine and case law.
