Lavery’s Daniel Bouchard to speak on wetlands January 28th at Complexe Jules-Dallaire in Ste-Foy
Wednesday morning, January 28th in Ste-Foy, Lavery’s Daniel Bouchard will deliver a talk regarding the legal aspects of wetlands management in a project development context. Bouchard, who is the firm’s office managing partner in Quebec City, will deliver his remarks after a co-presentation by two field specialists. This seminar, organized by the Canadian Bar Association Québec Branch, promises to be highly practical. It is intended for real estate developers (residential, commercial and industrial) but also municipal legal departments and general counsel. Stéphanie Destrempes to sit as a panellist at the Club de lecture Affaires
At noon on January 14, Ms. Stéphanie Destrempes, a lawyer in Lavery’s Franchising and Distribution practice group, will sit on a panel that will review Mr. Frédéric P. Gilbert’s work “Franchise Law in Québec” (Le droit de la franchise au Québec) at an event organized by Le Club de lecture Affaires. Norman A. Dionne of Lavery gives a conference on IT risk management and prevention in the workplace
On December 5, in Lavery’s Conference Center, Mr. Norman A. Dionne, a partner in Lavery’s Labour and Employment Law group, and Luc Chabot, president of Relais Expert-Conseil, gave a conference on information technology risk management in the workplace in front of 50 participants, mostly HR managers. During their presentation, they stressed the huge benefits of IT, the rights and obligations of employers and employees regarding risk prevention and management and the optimal framework to get the most out of IT integration in the workplace as part of a broader corporate strategy.

Pierre Marc Johnson of Lavery delivers an address on Canada-EU free trade in Sherbrooke
On December 11th in Sherbrooke, Mr. Pierre Marc Johnson, a former Premier of Quebec and counsel at Lavery recognized for his expertise in international trade and cross-border partnerships, spoke before a gathering of business leaders at an event organized by Carrefour Québec International. Québec’s chief negotiator for the Canada-EU Comprehensive Economic and Trade Agreement (CETA) spoke about the history and content of the agreement, as well as the opportunities it will make available to businesses from the Eastern Townships once it takes effect (expected in 2016). Pierre Marc Johnson and Marie-Hélène Jolicoeur of Lavery speak at the Stratégies PME 2015
On November 26 and 27, Mr. Pierre Marc Johnson, a senior advisor recognized for his expertise in international trade negotiations and cross-border business partnerships, and Ms. Marie-Hélène Jolicoeur, a lawyer specializing in Labour and Employment Law, both from Lavery, made presentations at Stratégies PME 2015, a unique, multiple-speaker event that seeks to contribute to the success of small-business leaders for the coming year. Mr. Johnson’s talk was entitled “Exporting to Europe: Why Take the Plunge Now?” while Ms. Jolicoeur’s presentation focused on “Dealing with a Problem Employee: Putting an End to the Frustration”. Mr. Patrick A. Molinari, Legal Counsel at Lavery, spoke at the Canadian Bar Association – Québec Branch’s mini-symposium Les caméras braquées sur nos aînés (cameras focusing in on our elders) held on November 20th at the 1000 de la Gauchetiere Conference Center. Mr. Molinari’s presentation was entitled La télésurveillance des usagers hébergés : la difficile conciliation des droits et des intérêts (Remote Monitoring of Inpatients: the Difficult Conciliation Between Rights and Interests), and covered the main legal issues establishments must take into account with regard to remote monitoring practices. Daniel Bouchard of Lavery speaks on contract management for the Fédération québécoise des municipalités (FQM)
On November 20, Daniel Bouchard, Managing Partner of Lavery’s Quebec City Office and lawyer specialized in the fields of municipal, environmental and administrative law, gave a web conference for the Fédération québécoise des municipalités (FQM) under the theme of “Contract Management Policy: Reminders and Status Report” (Politique de gestion contractuelle : rappels et état de la situation). During his discussion-type conference, Mr. Bouchard moderated a discussion regarding the contract management policy that every municipality must adopt under Article 938.1.2 of the Code municipal (C.M.), or under Article 573.3.1.2 of the Loi sur les cités et villes (L.C.V.). He highlighted which contracts fall under said policy, the minimum measures it must contain, how it must be distributed and the possible sanctions that could be imposed on elected representatives or public officials if the policy is not respected, either under Article 938.4 C.M. or under Article 573.3.4 L.C.V. Mr. Bouchard focused especially on how best to implement such a policy and the requisite monitoring actions. Based on jurisprudence and doctrine, he also discussed policy impact on the wording of municipal contracts and on the content of calls for tender in particular.

Éric Gélinas of Lavery Gives a Course on ITA Section 55 and Butterfly Transactions to UPA accountants
On November 25 in Quebec City, Éric Gélinas, Legal Counsel at Lavery, member of the Business Law Group in our Montreal office and specialized in complex tax reorganizations and the fiscal aspects of national and cross-border mergers and acquisitions, gave a workshop on ITA Section 55 and Butterfly Reorganizations for UPA accountants. More than 20 professionals attended the session.

Katia Opalka of Lavery speaks at Québec Mines about implications of the free trade agreement between Canada and the European Union
On November 19 in Quebec City, Katia Opalka, a partner at Lavery, gave a talk at a seminar on the mining sector in Scandinavia hosted by Export Québec as part of the Québec Mines conference. Ms. Opalka described the scope of the Canada-European Union Comprehensive Economic and Trade Agreement, the business opportunities it may present in the mining sector, and steps remaining before it takes effect. Patrick A. Molinari publishes a chapter in the collective work Droit et politiques de la santé
Patrick A. Molinari is the author of chapter 7, entitled Pratique médicale en établissement (Medical Practice in Institutions), in the collective work Droit et politiques de la santé (The Law and Health Policies) published recently by LexisNexis. In his chapter, Mr. Molinari offers up a detailed analysis of often-overlooked aspects of medical practice in health institutions. His analysis is twofold: he discusses how to gain access to practice in institutions and the terms thereof from the perspective of the obligations to which doctors are subject. The text will remain valid even after the current reform of the healthcare network is implemented.
