  1. Patrick A. Molinari elected first Vice President of CIAJ

    On October 13, 2015, Patrick A. Molinari, counsel at Lavery, was elected first Vice President of the Canadian Institute for the Administration of Justice (CIAJ) during the annual meeting of its board of directors in Saskatoon. The CIAJ is presided by the Hon. Justice Georgina Jackson of the Saskatchewan Court of Appeal. The CIAJ is a pan-Canadian non-profit organization promoting excellence and leadership in the administration of justice through knowledge, learning and the exchange of ideas. The CIAJ offers education and research programs and provides a forum for everyone interested in the administration of justice. The CIAJ was created in 1974 and is now comprised of over 1000 members of legal professions, the judiciary, and private and public organizations.

  4. Daniel Bouchard and Patrick A. Molinari to be awarded Lawyer Emeritus distinction by the Barreau du Québec

    Lavery is pleased to announce that Me Daniel Bouchard, Managing Partner of the Quebec City office, and Me Patrick A. Molinari, legal counsel, will be awarded the Lawyer Emeritus (Ad. E.) distinction by the Barreau du Québec during a ceremony to be held in October 2015. Me Bouchard and Molinari’s names will thus be added to the list of Lavery lawyers who have received this prestigious honorary award, created to pay tribute to exceptional legal careers. Called to the Barreau du Québec in 1991, Me Bouchard has specialized in the fields of municipal, environmental and administrative law. He has developed a special expertise in the areas of land use planning and development, agricultural zoning, mining environments, municipal liability, municipal management and ethics in public administration. He is regularly called on to give lectures or training and is also a trainer for the Conference of Municipal Judges. Me Molinari, called to the Barreau du Québec in 1975, has had an impressive career in academia. For more than 30 years, he taught at the Faculty of Law of the Université de Montréal. A significant component of his practice is devoted to Health Law and Regulatory and Public Law, and he has developed a thorough understanding of the legal framework of health services, addressing regulatory, contractual and commercial concerns. Co-author of the primary reference work on Quebec health law, he has also contributed to nearly 80 books and papers on the health and fundamental rights fields. “Lavery is delighted by the awarding of the Lawyer Emeritus (Ad. E.) distinction to Daniel Bouchard and Patrick A. Molinari. They both make a significant contribution not only to their profession but also to their respective areas of practice,” declared Don McCarty, the firm’s managing partner.

    Mr. Patrick A. Molinari, Legal Counsel at Lavery, spoke at the Canadian Bar Association – Québec Branch’s mini-symposium Les caméras braquées sur nos aînés (cameras focusing in on our elders) held on November 20th at the 1000 de la Gauchetiere Conference Center. Mr. Molinari’s presentation was entitled La télésurveillance des usagers hébergés : la difficile conciliation des droits et des intérêts (Remote Monitoring of Inpatients: the Difficult Conciliation Between Rights and Interests), and covered the main legal issues establishments must take into account with regard to remote monitoring practices.   6. Patrick A. Molinari publishes a chapter in the collective work Droit et politiques de la santé

    Patrick A. Molinari is the author of chapter 7, entitled Pratique médicale en établissement (Medical Practice in Institutions), in the collective work Droit et politiques de la santé (The Law and Health Policies) published recently by LexisNexis. In his chapter, Mr. Molinari offers up a detailed analysis of often-overlooked aspects of medical practice in health institutions. His analysis is twofold: he discusses how to gain access to practice in institutions and the terms thereof from the perspective of the obligations to which doctors are subject. The text will remain valid even after the current reform of the healthcare network is implemented.
