Me Awatif Lakhdar is part of the Family Law department which comprises personal law and estate law. Admitted to the Bar in 2002 her principal area of practice ahs been family law and private international law. 

Me Lakhdar has developed an expertise in extraterritorial disputes involving a foreign element.  Moreover she is regularly consulted by her colleagues regarding complex cases regarding the treatment of the concept of the Islamic dowry as pertains to a divorce in Quebec, the recognition of a divorce rendered abroad in accordance with Muslim law, the legal consideration of the concept of international public order, the reciprocal execution of foreign judgements in Canada, particularly pertaining to countries from the Middle East, international lis pendens and the increased interjurisdictional remedies, assisted procreation and gestational contracts, international adoption and the application of the Hague Convention of October 25, 1980 on international child abduction.

Over the course of the past few years, Me Lakhdar has been invited to speak on various topics regarding human rights, family law and inheritances.  She has participated in several conferences and has even created many conferences offered to lawyers, notaries, accountants, and tax specialists as well as financial institutions and organizations.

In collaboration with committees headed by the Consulate General of the Kingdom of Morocco in Montreal, she has sponsored several legal events aimed at the Maghreb community.

Me Lakhdar is also an accredited family mediator, as well as a civil, commercial and Small Claims Court mediator.  Over the years, Me Lakhdar has expanded her practice to “alternative dispute resolution” methods which includes mediation, and she has thus developed skills specific to this process to provide her clients with the most comprehensive principles.

She is fluent in French, English, and Arabic.

Representative mandates

  • Represents clients in provincial, national, and international cases, in particular in divorces, legal separations, child custody, establishment of spousal support (alimony), and application of matrimonial regimes;
  • She is often mandated to represent clients in international abduction cases whose country of origin is not a signatory to the Hague Convention.  She has also acted as legal advisor in matters relating to the identification of matrimonial regimes in certain Muslim countries;
  • She is regularly mandated as a jurisconsult in various trials relating to the determination of matrimonial regimes of immigrants from Muslim countries, therefore according to standardized foreign components;
  • She has developed an expertise in citizenship and immigration matters.  Therefore, in the context of divorce, nullity of marriage and foreign judgement recognition mandates she offers clients indispensable advice regarding the potential impact on their permanent residence in Canada or on the Sponsorship Contract signed with the provisional and federal immigration authorities.
